Terms of Service

These terms apply when you use Web Canvas, an app published by Curious Cat Consulting, LLC. Section 4 is the one worth reading carefully. It explains what we are and are not responsible for when you browse the web inside the app.

1. Accepting these terms

By downloading or using Web Canvas you agree to these terms. If you do not agree, do not use the app. If you are using it on behalf of an organization, you confirm you have authority to accept these terms for it.

2. Your license to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to use Web Canvas on devices you own or control, for your own purposes. You agree not to:

  • Copy, modify, reverse engineer, decompile, or attempt to derive the source code of the app, except where that restriction is prohibited by law
  • Rent, lease, sell, sublicense, or redistribute the app
  • Use the app to break the law or to infringe anyone’s rights
  • Use the app to circumvent access controls, paywalls, or usage limits on the sites you visit

3. Your canvases are yours

Everything you put on a canvas belongs to you. Because the app stores your sessions, notes, and history on your device rather than on our servers, we do not receive, host, or claim any license to your content. See our privacy policy for the detail.

You are responsible for keeping your own backups. Because there is no cloud copy, we cannot recover a saved session if your device is lost, damaged, reset, or if the app is deleted.

4. The web you browse is not ours

Web Canvas is a browser. The pages you open come from third parties, and we neither host, review, endorse, nor control any of them.

Windows on the canvas load pages directly from the sites you open, the same way any other browser does. Those sites set their own cookies, run their own scripts, collect their own data, and are governed by their own terms and privacy policies. We are not responsible for their content, their accuracy, their availability, or anything that happens to you as a result of using them.

The app does not filter or block content. If you are handing the app to a child, use your device’s own parental controls, because the app has none of its own.

5. Price and availability

Web Canvas is currently offered free of charge, with no subscription and no in-app purchases. We may change what the app offers, or stop offering it, at any time. If we ever introduce paid features, we will make the terms clear before you are charged.

6. Third-party services

The app uses a small number of third-party services described in our privacy policy, and it is distributed through the Apple App Store and Google Play. Their terms apply to their parts of the experience, and we are not responsible for services we do not control.

7. Disclaimer of warranties

To the fullest extent permitted by law, Web Canvas is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error free, that every website will render correctly inside it, or that saved sessions will always reload as expected.

8. Limitation of liability

To the fullest extent permitted by law, Curious Cat Consulting, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of saved sessions, loss of profits, or costs of substitute services, arising out of or relating to your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for it in the twelve months before the claim, or twenty five United States dollars.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. App Store and Google Play terms

If you obtained the app from the Apple App Store, you acknowledge that these terms are between you and Curious Cat Consulting, LLC only, not with Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use is also subject to Apple’s standard licensed application end user license agreement.

If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service, and these terms are between you and Curious Cat Consulting, LLC rather than with Google.

10. Termination

You may stop using the app at any time by deleting it. We may suspend or end your license if you materially breach these terms. Sections 3, 4, 7, 8, and 11 survive termination.

11. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Where permitted, disputes will be brought in the state or federal courts located in Florida. Nothing here removes any consumer protection right you have under the law of the place where you live.

12. Changes to these terms

We may update these terms, and the date at the top of this page will change when we do. Continuing to use the app after an update means you accept the revised terms.
